The Demise of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency triggered by the introduction of a new 28-point plan for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its response: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Diplomacy and Destruction

The sequence of conflicting incidents captured the grim essence of the recent timeframe. By day, diplomatic battles are fought: positive announcements are delivered from different nations. Immense energy is allocated on managing particular approaches. By night, Russian leadership clearly shows the world that, for them, conflict continues to be the primary tool for achieving "settlement".

Nighttime Reality

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was revealed. Ukraine is capable of detecting missile launches from across the border, a capability provided through current data. From witness perspectives, military aircraft that had been dispatched to engage hostile aerial threats flew past – sophisticated military planes supplied to Ukraine by Western partners.

Moments later, Kyiv's anti-aircraft weapons activated: defensive missiles deployed against a Russian ballistic missile. This was a sophisticated defense system at work, presumably supplied through partner states. Every firing shakes the surroundings, causing tremors. The instant of fear quickly gives way to sober acceptance: possibly the hostile projectile won't hit its mark this time, preventing destruction from devastation and additional electricity failures.

Ongoing Risks

Soon after, a heavy machine gun engaged a unmanned aircraft close by, part of a defensive team – probably allied-provided weaponry. Regrettably, the projectiles didn't strike the opposing UAV – it maintained course toward its objective.

With pauses, this persisted until dawn. Kyiv awoke to the early updates: multiple fatalities, devastation and heating outages in numerous residences as a result of the night's assault. As always, everyone still continued their routines – experiencing conflict. But those full day demonstrated Ukraine's essential dependence on Western support – a reliance that regional partners are clearly incapable to fill in the immediate future.

Failed Diplomacy

The 28-point plan from American leadership generated strong feelings, discussion and profound anxiety – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after prior negotiation attempts and bilateral conferences.

Every new proposal from Washington follows the same pattern: a political offensive against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually secure success. This pattern will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse particular leaders of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. US administration operates on a principle well known to international relations experts: you cannot win at the negotiating table what you have failed to defend militarily. The US administration believes that it is unfeasible to compel Moscow to surrender the areas that it already controls in Ukraine's south or east.

The problem is that while accepting these circumstances, US leadership does minimal to deter Moscow, through statements or actions, from thinking that the status quo will not change more in its advantage in the months ahead.

Conflicting Perspectives

Therefore, Moscow is convinced that the clock favors them – that Ukraine and its supporters are approaching exhaustion. Their incentive to agree to terms that does not give them the maximum possible gain is close to zero. There may be numerous efforts to end hostilities, but they will carry on as long as Russia's leader remains highly assured in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, slowly losing people and territory but averting a complete military breakdown until circumstances change in its advantage.

Current Realities

Factually, there are no real preconditions for a armistice. Now, personal considerations are entering the equation: political desires to mediate resolution and secure international recognition, and Kyiv's twin challenges – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the national cause against any proposal Kyiv finds unacceptable, so that their attention does not move to internal issues. And although their objective will now be significantly challenging after recent developments, it remains very improbable that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a just a single week to eliminate the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by US administration, opposition by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, latest revelations, all did their job.

While new plans based on old ideas are approaching, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are founded on Moscow's terms and demonstrate certain reluctance to modify developments, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the predictable period, mainly require sustained allied backing.
